Terms of Service

By accessing or using FanFicGen (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We recommend that you review these Terms carefully before using the Service.

These Terms constitute a legally binding agreement between you and FanFicGen. Your continued use of the Service after any modifications to these Terms constitutes acceptance of the updated Terms.

FanFicGen is a platform that enables users to generate fan fiction — transformative, fan-created literary works — using artificial intelligence. FanFicGen is not affiliated with, endorsed by, sponsored by, or licensed by any original intellectual property holder whose characters, settings, or other creative elements may be referenced in user prompts or generated stories.

Fan fiction occupies a complex area of intellectual property law. The legal status of any individual fan work depends on many factors, including the jurisdiction, the nature of the original work, and the extent of transformation. FanFicGen makes no representation or warranty that any content generated through the Service constitutes fair use, fair dealing, or is otherwise non-infringing under any applicable copyright, trademark, or other intellectual property law.

You acknowledge that generating and publishing fan fiction may carry legal risks, and you accept full responsibility for evaluating and assuming those risks. FanFicGen provides the technical infrastructure for AI-assisted story generation and does not provide legal advice regarding the permissibility of any generated content.

By using FanFicGen, you agree to use the Service in a lawful and responsible way. You must not misuse the Service, interfere with its operation, attempt to circumvent any access controls or rate limits, or use it to violate the rights of others.

You are solely responsible for the prompts you submit, the content you publish, and the way you share stories generated through the platform. You must review all generated content before publishing or sharing it.

By using the Service, you represent and warrant that: (a) you are at least 13 years of age (or 16 years of age if you reside in the European Economic Area); (b) you have the legal capacity to enter into these Terms; (c) your use of the Service complies with all applicable laws and regulations in your jurisdiction.

You further represent and warrant that: (a) any prompts, instructions, or other inputs you submit to the Service do not infringe the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party beyond the scope of permissible transformative or fan-created works; (b) you will not use the Service to generate content that impersonates real individuals, creates defamatory material, or is intended to mislead others into believing the content is an official or authorized work.

You acknowledge that AI-generated content may inadvertently resemble existing copyrighted works, and you accept sole responsibility for reviewing, verifying, and determining the suitability of any generated content before publishing, distributing, or otherwise making it available to others.

Some features require an account. You are responsible for maintaining the confidentiality and security of your login credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use of your account.

We may suspend, restrict, or terminate access to any account if we reasonably believe it is being used in a harmful, abusive, fraudulent, or unlawful manner, or in violation of these Terms. We reserve the right to remove any content that violates these Terms or applicable law without prior notice.

You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions, and that the legal status of ownership over AI-generated works is evolving. FanFicGen does not claim ownership of the stories generated through your use of the Service.

By generating and storing content on FanFicGen, you grant FanFicGen a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, display, distribute, and promote such content in connection with operating, developing, and improving the Service. This license includes the right to display stories on explore pages, in search results, and through any distribution channels used by the Service. This license survives termination of your account for content that remains on the platform.

FanFicGen retains all rights, title, and interest in and to the Service itself, including its technology, software, algorithms, user interface designs, trademarks, logos, and all related intellectual property. Nothing in these Terms grants you any right to use FanFicGen's branding, trademarks, or proprietary technology.

You agree not to use the Service to generate, publish, or distribute: (a) content that sexually exploits or endangers minors in any way; (b) non-consensual sexual content involving real persons; (c) content that incites, glorifies, or promotes violence against any individual or group; (d) content designed to harass, threaten, stalk, or intimidate a specific individual; (e) content that violates any applicable local, state, national, or international law or regulation.

You may not: (a) use the Service to produce content primarily for commercial resale or redistribution outside the platform; (b) access the Service through automated means (bots, scrapers, or similar tools) without prior written consent from FanFicGen; (c) attempt to circumvent, disable, or interfere with rate limits, security features, or other access controls; (d) reverse engineer, decompile, or attempt to extract the source code of the Service.

FanFicGen reserves the right, but has no obligation, to monitor, review, or remove any content at its sole discretion. Violation of this section may result in immediate account termination without prior notice.

You agree to indemnify, defend, and hold harmless FanFicGen, its operators, officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or relating to: (a) your use of the Service; (b) any content generated through your prompts or published under your account; (c) your prompts, inputs, or instructions infringing or allegedly infringing the intellectual property, privacy, publicity, or other rights of any third party; (d) your breach of any provision of these Terms; (e) your violation of any applicable law, regulation, or third-party right.

This indemnification obligation survives the termination or expiration of your account and these Terms. FanFicGen reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense of such claims.

FanFicGen respects intellectual property rights and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and similar laws in other jurisdictions.

If you are a rights holder or authorized agent and believe that content hosted on FanFicGen infringes your copyright, you may submit a takedown notice containing: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the material that is claimed to be infringing, including the URL or other specific location on the Service; (c) your contact information (name, address, telephone number, and email); (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; (f) your physical or electronic signature.

Upon receipt of a valid takedown notice, FanFicGen will promptly remove or disable access to the allegedly infringing content and notify the user who posted it. Users may submit a counter-notification if they believe the removal was made in error. FanFicGen maintains a repeat infringer policy and may terminate accounts of users who are the subject of multiple valid takedown notices.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, FanFicGen expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

FanFicGen does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) AI-generated content will be accurate, complete, reliable, or suitable for any particular purpose; (c) any generated content constitutes fair use or is non-infringing under any jurisdiction's intellectual property laws; (d) the results obtained from the use of the Service will meet your requirements or expectations.

FanFicGen's role is limited to providing the technical infrastructure for AI-assisted story generation. All creative decisions, prompt inputs, and responsibility for the resulting content rest solely with you, the user. You acknowledge and agree that your use of the Service, and any reliance on generated content, is at your sole risk.

To the fullest extent permitted by applicable law, in no event shall FanFicGen, its operators, officers, directors, employees, agents, licensors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the Service.

This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, warranty, or otherwise, and even if FanFicGen has been advised of the possibility of such damages. This limitation applies to, without limitation, any claims related to: (a) intellectual property infringement allegations arising from user-provided prompts or generated stories; (b) the accuracy, legality, or appropriateness of any AI-generated content; (c) any action taken by third parties, including intellectual property holders, in response to content generated or published through the Service.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of FanFicGen shall be limited to the greatest extent permitted by applicable law.

Paid subscriptions are billed through Stripe on a recurring monthly basis unless stated otherwise at checkout. By subscribing to a paid plan, you authorize FanFicGen to charge the applicable subscription fee through your selected payment method on a recurring basis.

You may cancel your subscription at any time. Upon cancellation, your paid features will remain available through the end of the current billing period, after which your account will revert to the free tier. No refunds or credits will be issued for partial billing periods or unused features.

FanFicGen reserves the right to modify subscription pricing with at least 30 days' advance notice. Continued use of a paid plan after a pricing change takes effect constitutes acceptance of the new pricing. If you do not agree with a price change, you may cancel your subscription before the change takes effect.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be subject to a 30-day informal resolution period, during which both parties will attempt in good faith to resolve the matter through direct communication.

If the dispute is not resolved during the informal resolution period, it shall be resolved through binding arbitration administered in accordance with the rules of a recognized arbitration body, except that either party may bring individual claims in small-claims court if eligible. The arbitration shall be conducted on an individual basis; class arbitrations and class actions are not permitted.

You agree to waive any right to participate in a class action, collective action, or representative proceeding against FanFicGen. This arbitration agreement and class action waiver shall survive the termination of your account and these Terms.

FanFicGen reserves the right to update or modify these Terms at any time. We will notify users of material changes through the Service or via the email address associated with your account. The "Last updated" date at the top of these Terms will be revised accordingly.

Your continued use of the Service after the effective date of any modified Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must discontinue use of the Service.

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.
